New Pharmacy Rule for Scheduled Medication Prescriptions
The Texas State Board of Pharmacy has adopted a new rule on information required on any scheduled medication prescription written by a Physician Assistant. The new rule requires the PA to enter the supervising physician's DEA number, as well as that of the prescribing PA's, on the scheduled medication prescription. These rules do not change what information is required on non-controlled medication prescriptions. The rule became effective on 7 September 2004 and will be placed in §291.34(b)(6)(C) of the Texas Administrative Code. In addition this rule does not change delegation authority for scheduled medications to a PA.
For your reference, an excerpt of the rules regarding the information required to be placed on prescriptions under the Texas Administrative Code is produced below, including the new rule mentioned above:
§291.34(b)(6)(C)
.. (C) All original written prescriptions carried out or signed by an advanced practice nurse or physician assistant in accordance with Subtitle B, Chapter 157, Occupations Code, shall bear:
(i) name and address of the patient;
(ii) name, address, telephone number, and if the prescription is for a controlled substance, the DEA number of the supervising practitioner;
(iii) name, identification number, original signature and if the prescription is for a controlled substance, the DEA number of the advanced practice nurse or physician assistant;
(iv) address and telephone number of the clinic at which the prescription drug order was carried out or signed;
(v) name, strength, and quantity of the drug;
(vi) directions for use;
(vii) indications for use, if appropriate;
(viii) date of issuance; and
(ix) number of refills authorized.
While TAPA representatives did actively present our opposition to the adoption of this new rule, the Pharmacy Board has adopted the rule; therefore compliance is required. TAPA does still recommend that you not have your's or your supervising physician's DEA number pre-printed on prescription forms. You should hand-write this information on the prescription to provide you better control over its release.
